Refund Policy

At Perez IP Laws, we are committed to providing professional and responsive intellectual property and legal services. We understand that circumstances may change after an order is placed. This Refund Policy explains when refunds may be available and which charges are eligible for refund.

This Refund Policy applies to services purchased through Perez IP Laws and should be read together with our Terms and Conditions and any applicable engagement agreement.

1. Full Refund Within 48 Hours

Clients may request a full refund of eligible service charges within forty-eight (48) hours of the original purchase.

A full refund under this provision applies only to the professional or service fees paid directly to Perez IP Laws.

Government filing fees, governmental charges, and other non-refundable third-party fees are excluded from this refund policy.

If a government filing fee has already been paid or submitted to the applicable government agency, that amount cannot be refunded by Perez IP Laws.

Where substantial professional services have already been completed within the initial 48-hour period, any refund will remain subject to applicable laws and professional rules governing attorney fees and services already performed.

2. Change-of-Mind Refunds

If a client decides not to proceed with a purchased service due to a change of mind after the full-refund period, the client may be eligible for a refund of 50% of the applicable service charges.

The remaining 50% may be retained to account for administrative processing, professional time, preparation, review, research, communications, and resources committed to the client’s matter.

Change-of-mind refunds apply only to eligible Perez IP Laws service charges and do not apply to government fees or other non-refundable third-party costs.

A change-of-mind refund may no longer be available where the requested service has been fully completed, subject to applicable law and professional rules.

3. Government Filing Fees Are Non-Refundable

All government filing fees are non-refundable once they have been paid or submitted to the applicable government authority.

This may include fees paid to:

  • The United States Patent and Trademark Office (“USPTO”);
  • The United States Copyright Office;
  • Foreign intellectual property offices;
  • International intellectual property organizations; or
  • Other governmental agencies or authorities.

Government filing fees are paid to governmental agencies and are not retained as service revenue by Perez IP Laws.

Accordingly, Perez IP Laws cannot refund a government fee merely because:

  • A client changes their mind;
  • An application is rejected or refused;
  • An office action is issued;
  • Registration is not obtained;
  • A patent is not issued;
  • Additional information is requested;
  • A government agency experiences processing delays; or
  • The client decides not to continue with the matter after the government fee has been paid.

4. Refunds Apply to Service Charges Only

Unless expressly stated otherwise in writing, all refunds under this Refund Policy apply only to service or professional charges paid to Perez IP Laws.

Refundable service charges do not include:

  • Government filing fees;
  • USPTO fees;
  • Copyright Office fees;
  • Foreign government fees;
  • International filing fees;
  • Third-party search or database charges already incurred;
  • Foreign associate or local counsel fees already incurred;
  • Translation expenses already incurred; or
  • Other third-party expenses that Perez IP Laws has already paid on the client’s behalf.

5. Services Already Performed

Refund eligibility may be affected by the amount of work already performed on a matter.

Work performed may include, without limitation:

  • Trademark or patent searches;
  • Legal research;
  • Application preparation;
  • Attorney review;
  • Document preparation;
  • Classification research;
  • Client consultations;
  • Correspondence;
  • Filing preparation;
  • Drafting responses or other legal documents; and
  • Other professional services relating to the client’s matter.

Where work has already been completed or expenses have already been incurred, Perez IP Laws reserves the right to deduct or retain the amount reasonably attributable to such work or expenses, subject at all times to applicable law, attorney professional-responsibility requirements, and the terms of any applicable engagement agreement.

6. Applications Already Filed

Once an application, response, registration request, or other document has been filed with a government agency, any associated government fees are non-refundable.

Refunds of Perez IP Laws service charges after a filing has been completed will depend upon the services already performed and the circumstances of the request.

A government agency’s refusal, rejection, delay, examination decision, office action, or other determination does not automatically create a right to a refund.

Perez IP Laws cannot guarantee the approval, registration, issuance, or successful outcome of any trademark, patent, copyright, or other intellectual property matter.

7. Errors by Perez IP Laws

If Perez IP Laws makes an administrative or filing error for which we are responsible, we will make reasonable efforts to correct the error as promptly as practicable and, where reasonably possible, without additional professional service charges to the client.

Any refund or corrective action will depend upon the circumstances of the matter and whether correction remains legally or procedurally available.

8. Requesting a Refund

Refund requests should include:

  • The client’s name;
  • The service purchased;
  • The approximate date of purchase;
  • The reason for the refund request; and
  • Any relevant order or matter information.

We may request additional information reasonably necessary to verify the transaction.

9. Method of Refund

Approved refunds will generally be issued to the original payment method used for the transaction where reasonably possible.

Processing times after a refund has been issued may vary depending upon the bank, credit-card provider, payment processor, or financial institution.

Perez IP Laws is not responsible for processing delays caused by a client’s bank or payment provider after the refund has been released by us.

10. Chargebacks and Payment Disputes

Clients are encouraged to contact Perez IP Laws directly regarding billing or refund concerns before initiating a chargeback or payment dispute.

Submitting a chargeback does not expand the client’s refund rights or make otherwise non-refundable government or third-party fees refundable.

Perez IP Laws reserves the right to provide transaction records, service records, communications, authorizations, filings, and other relevant documentation to payment processors or financial institutions when responding to a payment dispute, subject to applicable confidentiality and privacy obligations.

11. Engagement Agreements

Certain legal services may be governed by a separate engagement agreement, fee agreement, or other written agreement.

If the refund provisions of a signed engagement agreement differ from this general Website Refund Policy, the terms of the applicable engagement agreement will control with respect to that legal representation, subject to applicable law and professional rules.

Nothing in this Refund Policy is intended to waive or limit any rights or obligations relating to attorney fees, client funds, trust accounts, refunds, or termination of representation that cannot legally or ethically be waived.

12. Changes to This Refund Policy

Perez IP Laws may revise this Refund Policy from time to time.

Any revised policy will apply prospectively from its stated effective date and will not retroactively eliminate refund rights that had already arisen under an applicable agreement or law.
