Imagine you have a groundbreaking idea and invest in securing a utility patent to protect your invention. You launch it on Amazon, and it sells well—until you notice that other sellers are offering identical products. It’s a frustrating situation, but Amazon offers a solution for utility patent infringement cases on its platform.

In 2019, Amazon introduced its Neutral Patent Evaluation Process. This process allows a third-party evaluator—a patent attorney hired by Amazon—to decide if patent infringement has occurred. Let’s dive into what you need to know about this process.

Key Features of Amazon’s Neutral Patent Evaluation:

  • Confidential and voluntary
  • Low-cost alternative to litigation
  • Only for utility patents
  • Limited to one unexpired U.S. patent claim

How the Process Works

If you believe a seller is infringing on your patent by selling a copycat product on Amazon, you can file a claim through Amazon’s Neutral Patent Evaluation Process. Before starting, confirm the listings are infringing. Our team can assist you in determining this to save you time and protect your credibility with Amazon.

STEP ONE: Submit an Amazon Utility Patent Neutral Evaluation Agreement

To begin, contact Amazon’s legal department and prepare to:

  • Submit all relevant documentation for your utility patent
  • Identify infringing products by their ASIN (Amazon Standard Identification Number)
  • Explain how these products infringe your patent
  • Include up to 50 products per infringement claim

Building a strong case at this stage is essential.

STEP TWO: Amazon Notifies All Parties

Amazon sends a neutral patent evaluation agreement to both you (the patent holder) and the sellers you believe are infringing.

Accused sellers have three weeks to respond. If they choose not to participate, Amazon removes their listings. If they agree, Amazon assigns a third-party evaluator, requiring both parties to pay a $4,000 deposit, and the listings stay active during the investigation.

STEP THREE: Evaluation and Argument Submission

Once both parties pay the evaluator, they follow a set schedule for submitting arguments. The patent owner has 21 days for the initial argument, the seller has 14 days to respond, and the patent owner has an additional 7 days for a reply. The evaluator must make a decision within 14 days after submissions conclude.

Accused sellers can only make three arguments:

  • The product does not infringe on the patent
  • A court or relevant body has invalidated the patent claim
  • They have proof the product existed before the patent’s effective filing date

Since the patent owner provides the first and last arguments, presenting a clear, compelling case is crucial. Our patent expertise can help you build a strategy with strong, effective arguments.

STEP FOUR: Final Ruling

The evaluator issues a ruling. If you win, Amazon removes the infringing products, and your deposit is refunded. If not, the products stay listed, and the evaluator provides reasoning. Although appeals are not allowed, a federal lawsuit remains an option.

Successfully using Amazon’s Neutral Patent Evaluation Process strengthens your future infringement claims, potentially allowing you to report new cases without reinitiating the process.

In conclusion, Amazon’s Neutral Patent Evaluation is an efficient tool for inventors to protect their market share. Securing a utility patent can shield your product from imitators.
